(AMENDMENT) LAW

(in the form as amended and integrated with the Laws nr 13/1985; 36/1993 and 12/1997)
Parliament of the Turkish Federated State of Cyprus enacts the following Law:


SECTION I
GENERAL RULES

1.The Law herein is named The Foundation, Duty and Working Principles of the Presidency of the Turkish Republic of Northern Cyprus Act.
Interpretation
13/19852.Unless as otherwise stated in this Act:
"President" shall mean the President of the Turkish Republic of Northern Cyprus.
"Office of the President" shall mean the President's Office of the Turkish Republic of Northern Cyprus.
"Undersecretary" shall mean the Undersecretary of the Presidency of the Turkish Republic of Northern Cyprus.
"Director" shall mean the Director at the Office of the President.
"Special Guard" shall mean the Special Guard of the President of the Turkish Republic of Northern Cyprus.
"Aide" shall mean the Aide of the Presidency of the Turkish Republic of Northern Cyprus.

SECTION II
PURPOSE

Purpose of Foundation
13/19853.The purpose of foundation of the Office of the President is to assist the effective use and exercise of the duty and authorities of the President; to fulfil the duties concerning administrative, financial and other issues related to the Office of the President and Residence.

SECTION III
FOUNDATION AND DUTIES

Foundation
13/19854.The Office of the President  comprises of the Undersecretary, Director of the Presidency, Principal Clerk, Director of Consultancy and Political Works, Director of Press and Public Relations, Special Consultants, Consultants and Special Guard and the Aide of the Presidency.

Duty of the Undersecretary 13/19855.
The Undersecretary is the highest hierarchical superior of the Office of the President after the President. The Undersecretary is responsible for the planning, coordination and control of the services of the Office of the President, and the Undersecretary ensures the fulfilment of the administrative, legal, financial and other duties. The Undersecretary is responsible to the President.

The duties of the Director of the Presidency, 13/19856.
The Director of the Presidency  assists the Undersecretary with planning, coordination and control of the services of the Office of the President, and the fulfillment of the administrative, legal, financial and other duties. Furthermore, the Director ensures  personal rights of the personnel of the Office of the President, logistics, document, file and archive duties, transportation duties and the administrative services in relation to the Residency of the President, as well as the office services such as administrative and technical works and services. The Director is responsible to the President and the Undersecretary, and fulfils the duties properly assigned  by them.

The duties of the Principal Clerk
13/19857.The Principal Clerk  executes the private and official communications of the President, protocol and encoding works, archives the secret recorded correspondence and fulfils the official and private orders of the President. In addition to being bound to the Undersecretary concerning general duties, the Principal Clerk  conducts his duties in compliance with the orders to be given directly from the President.

In the absence of the, Principal Clerk, a person to be approved by the President or the Undersecretary shall fulfill this duty.

The duties of the Director of Consultancy and Political Works 13/19858.
The Director of Consultancy and Political Works executes the political works such as following up political relations with foreign countries and/or embassies  and external correspondence. The Director of Consultancy and Political Works ensures the work of Special Consultants and their secretaries. . He also executes the duties properly assigned to him by the President and the Undersecretary.

The duties of the Director of Press and Public Relations
13/19859.The Director of Press and Public Relations examines the oral or written applications concerning various issues, if necessary on-site made to the Presidency and finalizes them through coordination with the relevant bodies. He submits all types of news requiring press release, denial and notification by the Presidency, timely to the press and broadcasting organs; he keeps track of the local and foreign press daily and makes the President and the Undersecretary aware of articles containing important issues concerning the State and ensures the filing, classification of such articles to be presented when necessary. He also fulfils the duties properly assigned to him by the President and the Undersecretary.

Special Consultants 13/1985
13/198510 .Special Consultants are assigned concerning issues which are deemed necessary by the President; they are bound directly to the President and inform the President of their opinions on issues requested by the President.  They are employed through contracts on a full time or part time basis. The number and the allowance of Special Consultants to be assigned by contract are determined by the Budget Law each  year.

"However, regardless of their service, period of service, age limitation, contract period, retirement, or any other contrary rule under any other law, the President can employ a Special Consultant by contract as long as his services are required and based on conditions set forth by the President.

36/199310A.The President, within the framework of  Article 6 of the Public Servants Law, and provided that it is indicated each year in the Budget Law, can employ contracted personnel.

Consultants
13/198511.Consultants are responsible for the investigation, planning, coordination, control of the works in their specialty areas and  thereby providing recommendations to the President. The Consultants are provided by the relevant Ministry and Offices based on their specialty areas to serve for certain periods in  the areas of politics, economy, finance, law, national security and other necessary areas and are to be returned to their institutions at the end of their period of service.

Special Guard
13/198512.The Special Guard performs the duty of guarding the President and accompanies the President when necessary during his travels; The Guard takes the necessary safety measures and is always at the service of the President.

Aide of the President
13/198513.The Presidency Aide is assigned by the Security Forces Command upon the request and approval of the President. He is responsible for ensuring the security of the President and is directly bound to the President. He is always at the service of the President.

SECTION IV
MISCELLANEOUS RULES

Assignment of  Top Executives, Special Consultants and Consultants
53/ 1977
13/198514.(1)The Undersecretary, Director of the Presidency, Principal Clerk, Director of Consultancy and Political Works, and Director of Press and Public Relations, are assigned and removed from office in accordance with the rules foreseen in the Top Executives Law.
 (2)Special Consultants are assigned or posted directly by the President; Consultants  to be assigned from a Ministry and Offices are assigned or posted upon the recommendation of the Undersecretary and approval of the President.
 (3)The salary to be paid, associated rights and other issues of Special Consultants to be contracted shall be set forth in the contract.

Management Commission of the Office of the President
13/198515.The Management Commission of the Office of the President is  presided by the Undersecretary, it comprises of the Director of the Presidency, Principal Clerk, Director of Consultancy and Political Works, and Director of Press and Public Relations. This Commission shall examine and decide the issues relating to the management of the Office of the President submitted by the President or the Undersecretary.

B) The wage rate foreseen for each position in the First Schedule and Second Schedule attached to this law, are the equivalent to the levels and rates foreseen by the First Schedule attached to the Public Servants Law.
 (C) Staff of the Office of the President are indicated in the Budget Law every year and are filled in the framework of allowances to be inserted in the Budget Law every year.

Schedule

77/1989
36/1993 (2)The qualifications of the personnel to be assigned to the positions specified in the First Schedule, duty authority and responsibilities are foreseen in the service diagrams  in the Third Schedule attached to this law. The duty, authority and responsibilities of the personnel to be assigned to the Administrative Services Class, Literary Services Class and Errand runners/Driver Services Class indicated in the Second Schedule are indicated in the Personnel Office (Foundation, Duty and Working Principles) Law.
36/1993 (3)The Undersecretary designate public servants assigned to the allocated positions in the Office of the President to work in other suitable positions, provided that their personal rights and status are not prejudiced.

SECTION V
TEMPORARY RULES
Provisional Article Adaptation

13/19851.(1) The public servants already assigned to positions of the Turkish Federated State of Cyprus and in the resolution nr Ç-608-79 of the Council of Ministers published in the Official Gazette dated 10 August 1979 and nr 69 it is stated that they haven been adjusted as : undersecretary that of an undersecretary under this Law,  Principal Clerk that of a Principal Clerk under this Law, Interpreter/Translator that of a Interpreter/Translator under this Law and    Special Guard that of Special Guard under this law and the public servants occupying these positions shall be entitled to receive the wage rates and salaries of these positions set forth in this law.
  (2) One of the two Directors employed in the positions of the Office of the President currently, shall be assigned and adjusted to the position of Director of Consultancy and Political Works under this law; and the other to the position of Director of Press and Public Relations in accordance with rules of the Top Executives Law.
  (3) The dates of current wage rate increases of public servants shall remain unchanged.
  (4) The assignment of positions and wages other than the ones given in the First Schedule of the Law and foreseen in the (1st) subsection above shall be done in accordance with  the relevant articles of this Law and other applicable legislation.
Provisional Article Adaptation Processes
36/19932.(1)The relations of the public servants with such positions still working in the positions indicated in this Law shall continue exactly and the public servants shall continue to receive the wage rates and salary they are entitled by the position they occupy.
36/1993 (2)The personnel working as the Protocol, Administrative Services and Residence Official given in the First Schedule attached to the Main Law shall be adapted to the position of Protocol and Administrative Officer in this Law and the personnel working in the Waiter position shall be adapted to the position of Chief Waiter in this Law.
Provisional Article Adaptation Rule
36/19933.While adjusting to the suggested positions in this Law, the public servants being adjusted shall be adjusted to the degree corresponding to his/her current degree by considering the degree of such position.

FINAL RULES

13/198517.Upon the request and recommendation of the President, the Council of Ministers may make a Regulation to facilitate the application of this Law.
Authority for Execution
13/198518.The President executes this Law.
Enforcement
13/198519.The Law is enacted once it is published in the Official Gazette.

DUTY, AUTHORITY, AND RESPONSIBILITIES
(1) The Translator/Interpreter in particular translates the laws, regulations, decisions and notifications published in English and/or Greek as well as any official document, report, statement and other correspondence related to the Turkish Republic of Northern Cyprus into Turkish;
 (2) The Translator/Interpreter acts as a translator in the languages mentioned in the foregoing paragraph (1) during contacts with foreigners;
(3) The Translator/Interpreter   provides assistance to any Director upon assignment by the Undersecretary; and
(4) The Translator/Interpreter fulfills the duties to be assigned to him by the President, the Undersecretary and the Director of the Presidency including the translation of works from Turkish to English.
    
QUALIFICATIONS
(1) To have graduated from university or equivalent college in relevant subjects; or have graduated from high school or equivalent school;
(2) To have very good knowledge of Turkish, English and/or Greek languages and to be able to translate at least in one of the languages;
(3) To be successful in the examinations foreseen in the relevant legislation.

(1) The Head of Legal Works manages the legal works of the Office of the President under guidance of the President
and the Undersecretary:
(2) The Head of Legal Works provides legal opinions concerning the proper compliance with laws ;
(3) The Head of Legal Works performs other duties to be given by his superior that is suitable with his position; and
(4) The Head of Legal Works is responsible to his superiors to fulfill the duties.
    
 II. QUALIFICATIONS
(1) To have graduated from a Law Faculty of a recognized University and to pass the Bar Examinations pursuant to the applicable legislation;
(2) To  have worked at least six years in the public service; 
(3) To be successful in the examinations to be conducted pursuant to the relevant legislation.

POSITION OF HEAD OF FINANCIAL WORKS

 DUTY, AUTHORITY, AND RESPONSIBILITIES
 (1)The Head of Financial Works ensures the management of the budget and financial works of the Office of the President;
 (2)The Head of Financial Works follows up and ensures the performance of the tender, procurement, construction, accrual and payment works of the Office of the President;
 (3)The Head of Financial Works ensures the fulfillment of all works and actions related to the monthly salary and allowances and social security benefits of the personnel of the Office of the President.
 (4)The Head of Financial Works supervises, manages and ensures the performance of the relevant services related to the fixture, furniture, tools, equipments and material supply, storage, protection and service required for the Office of the President and the Presidential Residence; and
 (5)The Head of Financial Works   is responsible to the Undersecretary in fulfilling the duties completely, adequately and effectively.
    
 QUALIFICATIONS
 (1)To have worked at least for 3 years at Grade I of the Financial Services Class;
 (2)To be successful in the examinations to be conducted pursuant to the relevant legislation.

 DUTY, AUTHORITY, AND RESPONSIBILITIES
 (1)The Residential Technical Officer fulfills the technical work and services related to the Office of the President and the Residency of the President;
 (2)The Residential Technical Officer   performs the other duties to be given by his superiors; and
 (3)The Residential Technical Officer   is responsible to his superiors to fulfill the duties.
   
 QUALIFICATIONS
 (1) To have graduated from a Faculty issuing a diploma of Mechanical Engineering, Architecture, Electrical Engineering
and/or Civil Engineering or an equivalent higher education institution, to graduate as a “Mechanical Engineer”, “Architect”, “Electrical Engineer” and/or “Civil Engineer”;
 (2) To have worked at least for three years at Grade III of the Engineering and Architectural Services;
However, in case that there is no public official with proper qualification having worked for three years, the condition for having worked for one year shall be sought.
 (3) To be successful in the examinations to be conducted pursuant to the relevant legislation.

 DUTY, AUTHORITY, AND RESPONSIBILITIES
 (1) The Protocol Manager supervises the protocol works at meals and receptions given by the President and assists with the execution of Administrative works concerning the Presidency;
 (2) The Protocol Manager executes the duties properly assigned to him by superiors; and
 (3) The Protocol Manager is responsible to his superiors to fulfill the duties.
    
 QUALIFICATIONS
 (1) To have graduated from one of the faculties of Law, Economics, Political Sciences, Administrative Sciences or equivalent higher education institution or a secondary education institution, and to be entitled to qualify for this class pursuant to the article 75 of the Public Servants Law and to have worked in the public service for at least eight years;
 (2) To be successful in the examinations foreseen in the relevant legislation;
 (3) To have knowledge of English or another applicable foreign language.

 (1) The Protocol Officer executes the protocol works at the meals and receptions given by the President and assists with the execution of the Administrative works related to the Presidency;

 (3) The Protocol Officer is responsible to his superiors to fulfill the duties.
 
QUALIFICATIONS
(1) To have  graduated from one of the faculties of Law, Economics, Political Sciences, Administrative Sciences or equivalent higher education institution or a secondary education institution, and to be entitled to qualify for this class pursuant to the article 75 of the Public Servants Law and to have worked in the public service for at least six years;
(2) To have worked at least for three years in one grade lower position.
However, in case that there is no public official with proper qualification having worked for three years, the condition for having worked for one year shall be sought.
(3) To be successful in the examinations foreseen in the relevant legislation;
 (4)To have knowledge of English or another foreign language.

 (1) The Library and Classification Officer classifies and arranges the library and archive materials of the Presidency in compliance with the library and archiving techniques and presents them for the use of researchers;
 (2) The Library and Classification Officer performs other duties to be given by his superiors; and
 (3) The Library and Classification Officer is responsible to his superiors to fulfill the duties.

 QUALIFICATIONS
 (1)To have graduated from an University, academy, college or equivalent higher education institution or a secondary education institution in similar subjects, and to be entitled to qualify for this class pursuant to the article 75 of the Public Servants Law and to have worked in the public service for at least six years;
 (2)To work at least for three years in one grade lower position.

 (2)The Library and Classification Officer performs the other duties to be given by his superiors; and
 (3)The Library and Classification Officer   is responsible to his superiors to fulfill the duties.
   
 QUALIFICATIONS
 (1) To have completed a university, academy, college or similar higher education institution or a secondary education institution and to be entitled to qualify for this class pursuant to the article 75 of the Public Servants Law and to have worked in the public service for at least five years;
 (2) To have worked at least for three years in one grade lower position.
However, in case that there is no public official with proper qualification having worked for three years, the condition to have worked for one year shall be sought.
 (3) To be successful in the examinations to be conducted pursuant to the relevant legislation.

 (2) The Analyst/Programmer prepares the solution of the work flow of the projects approved;
 (3) The Analyst/Programmer works to develop the standards at the Information Processing Center and to make the development plans;
 (4) The Analyst/Programmer   ensures the implementation of statistical and off-the-shelf programs;
 (5) The Analyst/Programmer keeps the System Book up to date;
 (6) The Analyst/Programmer performs other duties to be given by his superiors suitable with his position; and
 (7) The Analyst/Programmer   is responsible to his superiors to fulfill these duties.
    
 QUALIFICATIONS
 (1) To have graduated a recognized university, to be trained in system analysis computer programming, and be able to operate at least both of them or all;
 (2) To have good knowledge of English;
 (3) To be successful in the examinations to be conducted pursuant to the relevant legislation;
 (4) Having at least 3-year experience in the profession shall be considered an advantage.
